Terms & Conditions of Sale

Welcome to Mini Highland Farms. These Terms and Conditions (“Terms”) govern your use of our website https://minihighlandfarms.com/ and the purchase of livestock (Miniature Highland Cattle) from our farm.

By placing a deposit or purchasing an animal from us, you agree to be bound by these Terms.

1. Livestock Reservations & Deposits

To reserve a specific calf, a non-refundable deposit is required.

• Deposit Amount: A deposit of [Insert Amount, e.g., $500 or 25%] is required to hold any animal.
• Reservation Status: An animal is not considered “Reserved” until the deposit has cleared.
• Non-Refundable: Deposits are non-refundable if the Buyer changes their mind, finds another animal, or is unable to complete the purchase for personal reasons.
• Breeder Cancellation: If the animal becomes sick, injured, or unfit for sale while in our care, we will refund your deposit in full or transfer it to another available calf of your choice.

2. Payment Terms

• Balance Due: The remaining balance must be paid in full before the animal leaves our farm.
• Accepted Methods: We accept [Wire Transfer, Cash, Certified Check, etc.]. We do not accept personal checks for final payment unless cleared 14 days prior to pickup.
• Boarding Fees: Animals must be picked up within [e.g., 14 days] of the agreed-upon release date. After this period, a boarding fee of $[Amount] per day will be added to the final balance to cover feed and care.

3. Health & Genetic Guarantee

We take pride in the health of our herd. Every animal is sold with a Certificate of Veterinary Inspection (CVI).

• 72-Hour Health Guarantee: We guarantee the animal is healthy and free of communicable diseases at the time of pickup. The Buyer has 72 hours from the time of possession to have the animal examined by a licensed veterinarian. If a pre-existing life-threatening condition is found, the Buyer may return the animal for a replacement or refund (upon provision of a written veterinary report).
• Genetic Guarantee: We guarantee our animals are free from known genetic defects (such as Chondrodysplasia, unless explicitly sold as a carrier/affected) for [e.g., 1 Year].
• Exclusions: This guarantee does not cover injury, illness, or death caused by:
  • Accidents or negligence during transport (after leaving our farm).
  • Improper feeding, care, or housing by the Buyer.
  • Common stress-related issues such as shipping fever, scours, or parasites that may occur due to the stress of moving.

4. Height & Sizing Disclaimer

While we use DNA testing and parentage to estimate adult size, we cannot guarantee the exact mature height of any calf. Terms such as “Micro” or “Miniature” are based on current IMCPS (International Miniature Cattle Breeders Society) standards and the size of parents. Nutrition and environment play a significant role in final growth.

5. Transport & Delivery

• Transfer of Risk: Responsibility for the animal passes to the Buyer the moment the animal is loaded onto the transport vehicle (whether the vehicle is owned by the Buyer or a third-party hauler).
• Third-Party Haulers: We can assist in arranging transport, but we are not liable for the actions, delays, or negligence of third-party livestock haulers. We highly recommend insuring your animal during transport.

6. Right of First Refusal (Optional but Recommended)

If, for any reason, you can no longer care for the animal, Mini Highland Farms retains the right of first refusal. You agree to contact us before selling or rehoming the animal. We may assist in placing the animal in a new home or taking it back (terms of buy-back to be negotiated at that time). We never want our animals to end up at auction or slaughter.

7. Limitation of Liability

In no event shall Mini Highland Farms be liable for any special, incidental, indirect, or consequential damages arising out of the sale of livestock. Our total liability is strictly limited to the purchase price of the animal.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising under these Terms shall be resolved in the courts located in Colorado.
